Terms of Use

These Terms of Use ("Terms") govern your access to and use of SkipMyW2.com (the "Site"), operated by Akasi Labs (dba Lovelace Media) ("we," "us," or "our"). By accessing or using the Site, including by interacting with our virtual assistant Samantha or texting "SKIPMYW2," you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. The Site is intended for residents of the United States who are interested in financing investment real estate.

SkipMyW2 is for investment property financing only. DSCR loans are not available for primary residences or owner-occupied properties. Do not use the Site if you are seeking financing for a property you intend to occupy as your primary or secondary residence.

2. About SkipMyW2 — What We Are and Are Not

SkipMyW2 is an educational resource and lead referral service for real estate investors interested in Debt Service Coverage Ratio (DSCR) loans. We connect investors with licensed third-party lending partners who offer DSCR loans.

Nothing on the Site constitutes financial, legal, tax, or investment advice. Information presented on the Site is for general educational purposes only and should not be relied on as a substitute for professional advice from qualified licensed professionals.

3. No Guarantees — Loan Approval and Terms

Loan approval is not guaranteed. Whether you qualify for a DSCR loan, the interest rate you receive, the down payment required, the maximum loan-to-value ratio, the minimum DSCR ratio, the loan term, fees, and other loan characteristics are determined entirely by the licensed lending partner based on their underwriting guidelines and your individual circumstances. These can change at any time without notice and vary significantly between lenders.

Any examples, calculators, ratios, scenarios, or sample numbers presented on the Site (including outputs from the DSCR calculator and Samantha) are illustrative only and do not constitute a quote, offer, pre-approval, commitment to lend, or guarantee of any kind.

4. The Lead Referral Process

When you submit your information through the Site, interact with Samantha, or text "SKIPMYW2," you understand and agree that:

• We will share the information you provide with one or more licensed lending partners selected at our discretion
• Those lending partners may contact you by phone, text, or email to discuss DSCR loan options
• Each lending partner operates independently and is solely responsible for its own products, services, communications, conduct, and privacy practices
• We may receive compensation from a lending partner if you connect with them or close a loan, which may influence which partners we work with — but does not affect what you pay or the terms you receive

5. Acceptable Use

You agree not to:

• Submit false, inaccurate, or misleading information
• Submit information about another person without their authorization
• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to access non-public areas of the Site, our servers, or our infrastructure
• Interfere with, disrupt, or attempt to overload the Site
• Reverse engineer, decompile, scrape, or copy any portion of the Site without our prior written consent
• Use the Site to transmit malware, spam, or unauthorized advertising
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

6. Intellectual Property

The Site and all of its content — including text, graphics, logos, illustrations, images, audio, video, software, designs, the SkipMyW2 brand, and the underlying code — are owned by Akasi Labs or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use to research DSCR loan options. All other rights are reserved.

7. User Communications and Submissions

By submitting information to us through the Site, including through Samantha and any forms, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, and process that information for the purposes described in our Privacy Policy, including sharing with licensed lending partners.

8. Third-Party Services and Lender Independence

The Site may link to or interact with third-party websites, products, and services — including those operated by licensed lending partners. We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your dealings with any third party are solely between you and that third party.

9. Disclaimers

THE SITE AND ALL CONTENT, FEATURES, INFORMATION, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND TITLE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SITE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AKASI LABS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SITE, ANY CONTENT ON THE SITE, OR ANY INTERACTION YOU HAVE WITH A LENDING PARTNER OR OTHER THIRD PARTY YOU CONNECT WITH THROUGH THE SITE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Akasi Labs and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or any rights of any third party; or (d) any information you submit to us, including any inaccuracies or misrepresentations.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice. All provisions of these Terms which by their nature should survive termination shall survive — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any dispute arising out of or relating to these Terms or your use of the Site.

14. Dispute Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us at dennis@akasilabs.com. We will try to resolve the dispute by contacting you by email. If a dispute is not resolved within thirty (30) days of submission, either party may bring a formal proceeding in accordance with Section 13.

15. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last Updated" date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and TCPA Notice, constitute the entire agreement between you and Akasi Labs regarding your use of the Site and supersede any prior agreements.
